Kansas has enacted Senate Bill 55 to amend K.S.A. 2025 Supp. 40-2404.
The bill adds a new section to establish new definitions and prohibit a person from soliciting or accepting an assignment, in whole or in part, of any post-loss insurance benefit under a residential property insurance policy. An assignment agreement, as newly defined, is considered against public policy and is null and void. A violation of the provision will be considered an unfair method of competition and an unfair or deceptive act or practice. Additionally, the bill establishes certain exceptions to this new provision.
