Kentucky Issues Bulletin Regarding the Use of Satellite and Aerial Imagery

On March 11, 2026, the Kentucky Department of Insurance issued Bulletin 2026-01 regarding the use of satellite and aerial imagery as a basis for cancellations, nonrenewals, and claim denials.

The bulletin states that while insurers may use satellite imagery as a tool to identify property degradation, damage, or other issues, insurers must conduct further investigation to validate any issues discovered from the use of satellite data. In addition, insurers may generally use aerial images, such as images taken from a drone or aircraft, as a basis for cancellation, nonrenewal, or claim denial if the images:

  • are clear enough to allow visualization of the specific property conditions that are noncompliant with the insurer's underwriting guidelines;

  • are accompanied by a written summary that clearly identifies the specific, noncompliant property conditions; and
  • contain a date stamp showing they were taken within the last 12 months.

An insured is entitled to review all satellite and aerial images relied upon to support a cancellation, nonrenewal, or claim denial by the insurer.
