Louisiana Enacts Multiple Bills

Louisiana has enacted multiple bills in this year's legislative session. Summaries of some of the recent bills follow.

 

House Bill 148

 

House Bill 148, among other provisions, adds that an insurer issuing a renewal policy of homeowners or private passenger motor vehicle insurance must provide the premium for the policy last issued by the insurer, and prominently display it in close proximity to the renewal premium. The bill also states that the determination of whether filed rates, supplementary rate information, and any supporting information are considered confidential, trade secret, or proprietary, is made by the commissioner.

 

House Bill 434

 

House Bill 434 increases the recovery limitations for motor vehicle accidents involving uninsured owners or operators to the first $100,000 for bodily injury and $100,000 for property damage.

 

House Bill 436

 

House Bill 436 establishes a new section which prohibits a person who is unlawfully in the Unites States from recovering general damages and past and future wages in an action for damages arising from an automobile accident. 

 

House Bill 549

 

House Bill 549 requires authorized commercial automobile insurers to provide a discount on the liability premium for commercial vehicles that have a dashboard camera with a minimum resolution of 1080p and a telematics system that collects and transmits real-time data on driving behavior to the insurer. Insurers should also submit an annual report to the commissioner by the first of March detailing the number of commercial vehicles receiving the discount, the aggregate savings provided to policyholders, and any observed changes in claim frequency or severity attributable to the use of dashboard cameras and telematics.
