Virginia has enacted House Bill 677 and Senate Bill 402. These bills include identical language.
Among other provisions, the bills state that no insurer should refuse coverage, cancel, or nonrenew a policy written to insure an owner-occupied dwelling solely based on the age of the dwelling's asphalt shingle roof if the roof is less than 15 years old or without permitting the owner or purchaser of the dwelling to provide written proof of the actual age of the roof. If such proof is not available, the insurer should permit a roof inspection by an authorized inspector at the owner's or purchaser's expense to determine the roof's actual age. Additionally, no insurer should refuse coverage, cancel, or nonrenew a policy written to insure an owner-occupied dwelling solely based on the condition of the dwelling's asphalt shingle roof if such roof is determined by an authorized inspector to have five years or more of useful life remaining. If the roof is at least 15 years old, the insurer should permit a roof inspection at the owner's or purchaser's expense before requiring a replacement as a condition of policy issuance or renewal.
