Colorado Issues Bulletin Regarding Wildfire Damage Sub-limits

On October 20, 2025, the Colorado Division of Insurance (DOI) issued Bulletin No. B-5.53 to provide their position on wildfire smoke, soot, ash, odor, and char damage sub-limits.
Colorado has amended 3 CCR 702-10, which, among other provisions, establishes governance and risk management requirements for private passenger automobile insurers that use external consumer data and information sources (ECDIS).
Colorado has enacted House Bill 1182, which, among other provisions, states that an insurer that uses a wildfire risk model, a catastrophe model, or scoring method to assign risk must provide the model or method to the Commissioner as part of a complete filing. The filing should include a description of the model, the impact of the model on rates, actuarial justification for all rating factors, mitigation discounts offered, and an explanation of the use of the model in underwriting decisions.
Colorado has enacted House Bill 1207, which, among other provisions, states that insurers may not refuse to issue, cancel, nonrenew, or increase a premium for a commercial policy for multifamily units—or a policy to cover the contents of a structure used for a residence and occupied by an owner or renter—based on the breed or mixture of breeds of a dog at the unit or structure. However, this does not prohibit an insurer from taking such action on the above-mentioned policies based on sound underwriting and actuarial principles on the basis that a particular dog at the unit or structure is known or declared to be dangerous.
Colorado Amends 3 CCR 702-5, Regulation 5-2-16

Colorado has amended 3 CCR 702-5, Regulation 5-2-16 to stipulate summary disclosure requirements and require that the summary disclosure form be provided in English and the summary document form be provided in Spanish for private passenger automobile insurance. The regulation provides the requirements and information that must be included in both summary forms. Additionally, every insurer should update and file a summary disclosure form and summary document form in SERFF to reflect any changes in major coverages and exclusions for private passenger automobile policies. Lastly, for policies effective on or after January 1, 2026, insurers must provide a language selection form to any new applicants at the time of application and to renewal policyholders at the first renewal following January 1, 2026.
