    Washington State Issues Low-Income Housing Data Call

    On July 22, 2024, the Washington State Office of the Insurance Commissioner (WOIC) issued a data call with instructions and the worksheet that is to be submitted. Companies that may have provided any property and/or liability coverage with effective dates between January 1, 2019, and December 31, 2023, to housing providers receiving housing trust fund resources and serving extremely low-income households must complete the data call. If, after review, companies identify that they have not provided any such coverage, they only need to complete the first tab of the worksheet for submission. All responses should be emailed to datacall@oic.wa.gov by the close of business on August 27, 2024.

    Illinois Enacts House Bill 5559

    Illinois has enacted House Bill 5559, which amends the Illinois Insurance Code and states that insurers must provide the insured with a brief description of how the determination of a total loss of an insured vehicle was made. This includes any available repair estimate, estimated vehicle salvage value, assessed market value, and other costs and calculations that were used. This applies to policies issued or renewed on or after July 1, 2025.

    Rhode Island has enacted House Bill 7507 and Senate Bill 2681. The bills state that if an insurer refuses to honor a direction to pay that is executed by an insured or claimant to have the insurer directly pay the insured's property damage benefit to the restoration company of the consumer's choice, provided that the claim is no more than $5,000 and the restoration company is licensed, it constitutes an unfair claims practice.

    Louisiana Enacts House Bill 609

    Louisiana has enacted House Bill 609, which, among other provisions, outlines the appraisal process. The bill states that upon a demand for appraisal, the insurer and claimant should each select an independent and qualified appraiser. If the appraisers do not agree on the amount of loss, then they should select an independent and qualified umpire. In the event that the appraisers are unable to agree on an umpire, then either appraiser may submit a request for the judge to select one. Additionally, the bill outlines other details, including appraiser qualifications and umpire selection. The bill will apply to all property insurance policies issued, delivered, or renewed on or after January 1, 2025.
