On October 20, 2025, the Colorado Division of Insurance (DOI) issued Bulletin No. B-5.53 to provide their position on wildfire smoke, soot, ash, odor, and char damage sub-limits.

The DOI views wildfire smoke, soot, ash, odor, and char damage as direct extensions of wildfire damage and states that including sub-limits on these specified damages has the capacity to undermine the essential protection that policyholders expect to be provided in their residential property insurance policies. The DOI expects insures to refrain from including such sub-limits in their residential property policies and administer claims accordingly.
