    Colorado Issues Bulletin Regarding the Use of Aerial Imagery

    The Colorado Division of Insurance (Division) has issued New Bulletin No. B-5.57 regarding the Division's position on the use of aerial imagery by insurers in underwriting, pricing, or claims decisions.

     

    The bulletin states that insurers are expected to exercise reasonable care to ensure that aerial imagery relied upon is appropriate for the purpose for which it is being used. The bulletin provides certain factors that insurers should consider when determining whether the aerial imagery reasonably supports the decision being made. Among other things, the bulletin states that aerial imagery used to capture certain visible conditions should not be relied upon as the sole basis for adverse actions, and that when aerial imagery does not clearly demonstrate the cause, extent, or severity of damage in a claim determination, insurers should conduct further investigation.
