Oregon has adopted new rules OAR 836-054-0110, -0115, -0120, -0125, and -0130 to clarify ORS 742.075, which requires insurers to give a clear and reasonable written explanation for any increase in the amount of premium the insured must pay upon renewing certain policies when a written request from the insured is received. Among other provisions, the new rules outline the required written explanation and minimum information to be included in the contents of the premium change notice. Additionally, they establish that qualified insurers must report to the department no later than April 30, 2028, and no later than April 30 of every other year thereafter, certain specified information pertaining to renewals, premium increases, and requests for explanations.
