Texas has adopted new 28 TAC §5.9503 and §5.9504 concerning statistical plans for residential and private passenger auto risks.
The rules were adopted to implement House Bill 2067, which, among other provisions, requires insurers to disclose to consumers their reasons for cancellation or nonrenewal of an existing policy or for declination of an application. Insures must also provide the Texas Department of Insurance (TDI) with a written report organized by ZIP code that summarizes the reasons provided to consumers.
28 TAC §5.9503 and §5.9504 adopt by reference the revised Texas Statistical Plan for Residential Risks and Texas Private Passenger Auto Statistical Plan. Insurers are to use these updated plans to submit the required reports to the TDI.
