Texas has issued an adoption order for amended rule 28 TAC §5.205 regarding the Motor Vehicle Crime Prevention Authority (MVCPA) fee.

Subsection (a) of the amended rule removes the $4 fee amount and replaces it with a reference stating that insurers must pay the MVCPA fee that is set forth in Transportation Code §1006.153(b). Instead of replacing it with the updated fee of $5, this revision removes the need to update the fee amount when it is changed in the statute. Additionally, subsection (b) was amended to update the notice that insurers must provide to the policyholder upon the recoupment of the MVCPA fee.
