Utah has enacted House Bill 48, which, among other provisions, provides new definitions and insurance requirements regarding wildland urban interface property.
The bill states that when trying to determine whether a property is high risk wildland urban interface property, insurers must use the boundary provided in the wildfire risk assessment mapping tool maintained by the Division of Forestry, Fire, and State Lands.
Additionally, if an insurer cancels or nonrenews property and casualty insurance on a wildland urban interface property due to wildfire risk, the notice must include the facts on which they based their decision. If the premium is increased by more than 20% due to wildfire risk, then the insurer must provide the facts on which they based their decision if it is requested by the insured.
