California Issues Mandatory Moratorium in Response to Wildfires

On September 14, 2023, the California Department of Insurance (CDI) issued Bulletin 2023-6 which announced a mandatory moratorium on cancellations and non-renewals in response to the declaration of a state of emergency. The moratorium prohibits any admitted or non-admitted insurer writing residential property insurance in the state of California from issuing a notice of cancellation or non-renewal for one year, starting on August 29, 2023 in affected ZIP codes. 

 

The affected ZIP codes for which the moratorium applies are:

  • Smith River Complex Fire: 95531, 95532, 95543, 95546, 95548, 95556, 95567, 95568, 96039
  • Happy Camp Complex Fire: 95543, 95556, 95568, 96027, 96031, 96032, 96034, 96037, 96039, 96044, 96050, 96085, 96086, 96097

If any insurers to which the moratorium applies have issued a notice of cancellation or non-renewal since the declaration of a state of emergency on August 29, 2023, they must offer to rescind those notices.
