Maryland Releases FAQ Regarding EUIM Coverage Opt-Out Form

The Maryland Insurance Administration (MIA) has received many questions from carriers since their development and issuance of the new mandatory Enhanced Underinsured Motorist (EUIM) coverage opt-out form, required by Maryland House Bill 128 (2023). In response, the department has compiled the 21 most common questions and provided applicable answers.

 

Pursuant to Maryland HB 128, EUIM coverage will transition from an "opt-in" coverage to an "opt-out" coverage for new private passenger auto policies issued, sold, or delivered in Maryland on or after July 1, 2024. Under the new law, unless the first-named insured affirmatively waives EUIM coverage in writing using a form developed by the MIA, all new private passenger auto policies issued, sold, or delivered on or after July 1, 2024, must include EUIM coverage. The MIA distributed the required form with Bulletin 23-12.
